An estate plan consists of the following components:

  • Wills and trusts: A will is a legal document that allows you to spell out how your assets will be distributed and who will be responsible for the administration of your estate. Your estate plan can also contain one or more trusts to accomplish specific goals.
  • Durable powers of attorney: A durable power of attorney is an important part of your estate plan. This document allows you to name a trusted agent (usually a family member) to manage your financial affairs if you are incapacitated. If you become incapacitated without a power of attorney, your loved ones may have to go through the time and expense of a guardianship proceeding to do basic things like pay your bills or sell property.
  • Health care power of attorney and health care directive: In Missouri, these are two parts of the same form. The health care directive is the same thing as a living will. It allows you to tell doctors and family members whether you want artificial life support (such as feeding tubes) if you are in a terminal condition with no hope of recovery. The health care power of attorney names a trusted agent to communicate your desires to medical care providers if you are unable to speak for yourself. The health care power of attorney includes HIPPA authorization, which allows your agent to access your medical information.
